SO PASTOR DE LA CRUZ STARTED HIS THEOLOGICAL STUDIES AT THE UNIVERSIDAD DE MONTEMORELOS IN MEXICO, WHERE I'VE BEEN.

IT'S A VERY LOVELY CAMPUS, AND HE FINISHED HIS STUDIES AT CAREY BIBLE COLLEGE.

HE PASTORS HERE TWO SEVENTH DAY ADVENTIST CHURCHES, SPANISH SPEAKING CHURCHES.

ONE IS EASTGATE ON THE EAST SIDE.

THE OTHER IS BYNUM SEVENTH DAY ADVENTIST CHURCH ON THE SOUTH SIDE, OFF OF BYNUM AND MILITARY.

EVEN THOUGH HE'S FROM MEXICO, HIS WIFE IS FROM SAN ANTONIO, AND HE HAS LIVED ON THE SOUTH SIDE FOR OVER 30 YEARS.

THANK YOU, JUDGE. I KNOW WE'RE GOING TO GET TO CEREMONIAL ITEMS IN A MINUTE, BUT I WANTED TO JUST BRIEFLY RECOGNIZE SOME SPECIAL VISITORS WE HAVE IN THE AUDIENCE TODAY.

THEY ARE THE STUDENT LEADERS FROM SAINT PAUL'S CATHOLIC SCHOOL IN THE HEART OF PRECINCT TWO.

THESE YOUNG LEADERS ARE SIXTH AND SEVENTH GRADERS, PART OF THE STUDENT COUNCIL THERE AT SAINT PAUL'S.

WE WANT TO THANK YOU GUYS FOR BEING HERE AND SHARING PART OF YOUR MORNING WITH US.

I KNOW IT'S TOWARDS THE END OF THE SCHOOL YEAR, BUT THESE YOUNG LEADERS ARE REALLY TRULY LIVING THE SPIRIT OF LEADERSHIP, NOT JUST ON CAMPUS, BUT IN THEIR COMMUNITY. WE KNOW THEY'RE GOING TO DO GREAT THINGS AS THEY GO ON TO MIDDLE SCHOOL AND INTO HIGH SCHOOL.

WHEREAS ON MAY 14TH, 2014 AND INCORPORATION ELECTION WAS HELD WITH 75% FOR AND 25% AGAINST INCORPORATION, THE COMMUNITY, KNOWN PREVIOUSLY AS WATER WOOD HAD ELECTED TO INCORPORATE INTO BEXAR COUNTY AND BECOME THE CITY OF SANDY OAKS, AND WHEREAS THE CITY COVERS A TOTAL OF 2.38MIĀ², HAS A POPULATION OF OVER 5000 PEOPLE, AND IS LOCATED ON THE SOUTHEAST SIDE OF BEXAR COUNTY, NESTLED GENTLY AGAINST LUCIAN ADAMS FREEWAY I-37--NO ONE CALLS IT THAT.

[CHUCKLING] I-37 JUST SOUTH OF LOOP 1604, WHEREAS A POLICE DEPARTMENT, PUBLIC WORKS DEPARTMENT, AND ANIMAL CONTROL DEPARTMENT WERE ESTABLISHED TO PROVIDE FOR AND PROTECT THE CITIZENS OF SANDY OAKS, AND WHEREAS THIS YEAR MARKS THE 10TH ANNIVERSARY OF THE CITY OF SANDY OAKS, WE JOIN IN THE EXPRESSION OF THEIR PRIDE AND APPRECIATION.

SAY OUR PRIDE BECAUSE I'M OUT THERE A LOT.

OUR PRIDE AND APPRECIATION FOR THE MANY CIVIC AND ECONOMIC BENEFITS, GROWTH AND PROSPERITY THEIR COMMUNITY HAS ENJOYED OVER THE PAST TEN YEARS.

WHILE I MAINTAIN THAT IT IS AN EVENTUALITY WITH REGARD TO LAW ENFORCEMENT, WE DO KNOW THAT IT IS SOMETHING THAT WE HAVE TO MANAGE, AND IT'S WHAT WE ARE DOING.

BROUGHT WITH ME A LIST OF CALLS FOR SERVICE.

PRETTY HIGH PROFILE. WITHIN THAT TIME PERIOD.

I'D BE MORE THAN HAPPY TO SHARE THOSE WITH YOU.

I WON'T GO INTO GREAT DETAIL ON THE MICROPHONE RIGHT NOW, BUT I CAN TELL YOU THE SEVERITY OF THESE CALLS IS WHAT'S DRIVING A LOT OF OUR OVERTIME ON THE LAW ENFORCEMENT SIDE OF THE HOUSE WITH REGARD TO DETENTION.

WE KNOW THAT, YOU KNOW, THERE'S ONLY TWO REAL WAYS TO POSITIVELY AFFECT OVERTIME COSTS IN THE JAIL TO RECRUIT AND HIRE, WHICH IS WHAT WE'RE DOING A LOT OF AND TO LOWER THE INMATE POPULATION, WHICH AT PRESENT, WE KNOW THAT'S NOT POSSIBLE TO DO.

VIOLENT CRIME CONTINUES TO RISE, WHICH MEANS MORE VIOLENT FELONS ARE FINDING THEIR WAY INTO OUR JAIL.

DUE TO THE HARD WORK OF THE LAW ENFORCEMENT SIDE OF THE HOUSE, AS WELL AS OUR PARTNER AGENCIES THROUGHOUT THE COUNTY.

WE KNOW THAT THE NUMBER OF FEMALE INMATES IS UP.

MENTALLY ILL INMATES IS UP.

INMATES REQUIRING HOSPITAL HOSPITALIZATION IS UP, WHICH IS THESE ARE ALL MORE LABOR INTENSIVE AS WELL AS YOUTHFUL OFFENDERS, AS WAS POINTED OUT BY A RECENT FOX 29 STORY, WE'RE SEEING AN UNPRECEDENTED NUMBER OF YOUTHFUL OFFENDERS IN THE JAIL, AND SO WITH THAT BEING SAID, I'VE BROUGHT ALONG SEVERAL MEMBERS OF MY COMMAND STAFF WHO ARE PREPARED TO ADDRESS A LITTLE MORE IN DETAIL.

THE EXTENT THAT WE ARE TAKING THAT WE ARE GOING TO TRY TO REDUCE OVERTIME, BUT ALSO TO GIVE YOU A MORE CLEAR PICTURE OF BOTH SIDES OF THE HOUSE.

SO LET ME GO AHEAD AND BRING UP DEPUTY, OUR ASSISTANT CHIEF, JOEL JANSSEN, FIRST ON THE DETENTION SIDE.

SO CURRENTLY FROM JANUARY TO NOW, WE'VE INCREASED OUR FULL TIME EMPLOYEES ON THE FLOORS AT THE JAIL BY 76.

WE CURRENTLY HAVE 72 IN THE ACADEMY.

SO WITH THAT DONE AND TOTAL VACANCIES, WE'RE CURRENTLY AT 146.

OUR OVERTIME, LIKE I MENTIONED BEFORE IN OTHER COURT SESSIONS, IT SPIKED BECAUSE OF APRIL.

MARCH, AND APRIL IS BECAUSE WE PULLED THE TEMPORARY JAILERS OUT OF THE JAIL, AND WE PUSHED THEM THROUGH THE ACADEMY.

THOSE INDIVIDUALS ARE NOW GRADUATED IN MAY, AND NOW WE'RE GOING TO START SEEING A DECREASE COME MAY AND THEN A HUGE DECREASE IN JUNE.

CHIEF, I JUST HAD A QUESTION, BY MY COUNT, GOING ON A ROUGH VACANCY OF 200 IN THE JAIL A YEAR AGO, LET'S JUST SAY, OR SO. IT LOOKS LIKE A NET 54, YOU KNOW, WITH THE REGULAR ATTRITION AND RETIREMENT AND EVERYTHING ELSE.

I WANT TO RECOGNIZE YOUR WORK IN THE WARRANTS EXECUTION AND PICKING THE VIOLENT OFFENDERS UP.

THAT WAS THE SPECIFIC TASK OF THE PUBLIC SAFETY COMMITTEE.

ALSO TO THE DA'S OFFICE IS WORKING ON THE BACKLOG, AND THAT MEANS THAT THERE ARE MORE WARRANTS COMING OUT OF THAT PROCESS, AND ALSO, TOO, WE KNOW THAT THE COURTS ARE WORKING HARD, AND ALTHOUGH WE'VE HAD A SIGNIFICANT INCREASE IN ALL THOSE ISSUES, THE COURTS ARE MOVING PEOPLE OUT, AND OBVIOUSLY WE STILL HAVE ISSUES WITHIN OUR JAIL THAT WE HAVE PEOPLE THAT ARE STILL SITTING IN THERE WAITING TO GET TO TRIAL, WAITING FOR THE CASE TO DISPOSE, BUT WE ALSO HAVE ANOTHER SET OF GROUP OF PRISONERS THAT ARE WAITING TO GO TO STATE STATE PRISON OR STATE JAIL, ALSO, TOO, WE HAVE THE MENTALLY ILL AND WE HAVE PEOPLE THAT ARE NOT UNABLE TO PROCESS OUT.

SO AGAIN, I APPRECIATE ALL THE EFFORTS THAT YOU DO TO MOVE ALL THAT POPULATION, AND I WANT THE PUBLIC TO KNOW THAT ALTHOUGH THE JAIL POPULATION HAS GONE UP FOR THE REASONS THAT YOU STATED, I THINK IT OVERALL WE HAVE MADE OUR COMMUNITY SAFER AND THE RECORD REALLY IS, SHERIFF, THAT CRIME RATES ARE GOING DOWN STATICALLY, NOT NOT SIGNIFICANT, BUT THEY'RE NOT GOING UP, ALTHOUGH THE MEDIA OBVIOUSLY MAY NOT PAINT THAT PICTURE.

LAW ENFORCEMENT THAT HAVE TATTOOS FROM THEIR FINGERTIPS ALL THE WAY TO THE SHOULDERS AND ITS VISIBILITY.

CONSERVATIVE ESTIMATES SAY THERE ARE ABOUT 8% OF OUR BEXAR COUNTY RESIDENTS THAT ARE NON-CITIZENS, ANYWHERE FROM 8 TO 13%.

THAT REPRESENTS ABOUT 160 TO EITHER 240,000 PEOPLE THAT LIVE AND RESIDE HERE IN BEXAR COUNTY.

THE CHILDREN OF DETAINED AND DEPORTED PARENTS FACE ENORMOUS HEALTH AND MENTAL HEALTH CHALLENGES THAT CAN LEAD TO NEGATIVE OUTCOMES FOR INDIVIDUALS, AND NEXT SLIDE. THE COMMISSIONERS ON JULY 12TH RECOGNIZED THE BEXAR COUNTY STRIVES TO PROTECT CHILDREN AND KEEP FAMILIES TOGETHER TO SUPPORT INDIGENT RESIDENTS, AND IS COMMITTED TO ENSURING IMMIGRANTS HAVE ACCESS TO FAIR AND AFFORDABLE LEGAL REPRESENTATION AND DEPORTATION PROCEEDINGS. BEXAR COUNTY WOULD BE JOINING THAT NETWORK ALONG WITH OTHER JURISDICTIONS SUCH AS HARRIS COUNTY AND CITIES INCLUDING DALLAS, SAN ANTONIO AND AUSTIN, AND SO WHAT WE'VE SEEN, BECAUSE OF THE VARYING NATURE OF THE KINDS OF IMMIGRATION DEFENSES THAT PARENTS, FAMILIES, CHILDREN QUALIFY FOR IT, WE'VE SEEN THROUGH THE RESEARCH BY THE VERA INSTITUTE THAT IT'S BASICALLY VERY HARD TO IDENTIFY AN AVERAGE COST BECAUSE THE CASES ARE SO DIFFERENT, AND I THINK ONE THING THAT WE'VE SEEN THROUGH THE RESULTS OBTAINED THROUGH THE PROGRAM IS PARENTS RETURNING BACK HOME TO THEIR CHILDREN OBTAINING LAWFUL STATUS UNDER A FEDERAL IMMIGRATION LAW.

WE'VE ALSO SEEN CLIENTS WHO DON'T QUALIFY FOR THAT TYPE OF RELIEF AND ARE ABLE TO RESOLVE THEIR CASES MUCH FASTER, MAKING THE COST OF THAT CASE MUCH LOWER.

WELL, COMMISSIONER, WHAT WE'VE SEEN THROUGH THE OPERATION OF THESE PROGRAMS REALLY AROUND THE COUNTRY AND ALSO THE SERVICES ALREADY PROVIDED FOR MANY DECADES HERE IN SAN ANTONIO BY THE NONPROFITS, IS THAT THERE ARE MANY QUALIFYING CLIENTS WHO WON'T HAVE HAD CONTACT WITH THE CRIMINAL LEGAL SYSTEM OR EVEN NECESSARILY THE DHS ENFORCEMENT SYSTEM, BUT WHO NOW ARE FACING DEPORTATION PROCEEDINGS THROUGH SOME OTHER MECHANISM THAT BROUGHT THEM INTO THAT CONTACT WITH DHS.

WHAT ARE THE GUARDRAILS AND CONSTRAINTS UPON WHO WOULD QUALIFY FOR THIS PROGRAM? BASED ON ANY KIND OF CRIMINAL HISTORY? THAT'S WHY 80% OF PEOPLE THAT ARE FACING DEPORTATION HERE IN THE SAN ANTONIO IMMIGRATION COURT DO NOT HAVE LAWYERS, AND THAT'S A CONTEXT IN WHICH THERE'S A HIGHLY TRAINED GOVERNMENT LAWYER AGAINST THE PERSON WHO'S HAVING TO NAVIGATE AN EXTRAORDINARILY COMPLICATED POTENTIALLY DEFENSE IF THEY HAVE IT, AND I THINK THAT THE SECOND POINT THAT'S RELEVANT TO YOUR QUESTION, COMMISSIONER, IS THAT EVERY DEFENSE THAT CAN BE BROUGHT UNDER THESE AGREEMENTS IS ONE THAT'S BEEN CREATED BY CONGRESS UNDER FEDERAL

ON NOVEMBER 9TH, 2023, TREASURY RELEASED A NEW INTERIM FINAL RULE TO ADDRESS RECIPIENTS QUESTIONS REGARDING THE DEFINITION OF OBLIGATION AND TO PROVIDE RELATED GUIDANCE AND CLARIFYING INFORMATION.

THE OBLIGATION IFR DID NOT ALTER THE EXISTING SLFRF OBLIGATION OR EXPENDITURE DEADLINES.

WE STILL MUST OBLIGATE BY DECEMBER 31ST, 2024 AND EXPEND FUNDS BY DECEMBER 31ST, 2026.

SO WHAT EXACTLY DID THAT IFR DO? IT CLARIFIED THE DEFINITION OF OBLIGATION, WHICH MEANS AN ORDER PLACED FOR PROPERTY AND SERVICES, AND ENTRY INTO CONTRACT, SUBAWARDS AND SIMILAR TRANSACTIONS THAT REQUIRE PAYMENT.

THIS DEFINITION IS BASED ON THE UNIFORM GUIDANCE DEFINITION OF FINANCIAL OBLIGATIONS.
